Candlelight Interactive, LLC ("Company") takes your privacy seriously. Company pledges to follow the provisions of this privacy policy in order to protect your privacy rights.

This Privacy Policy ("Policy") outlines Company's general policy and practices for protecting your private information on this website and related services (collectively, the "Site"). It includes the types of information Company gathers, how it uses the information, and the choices individuals have regarding Company's use of their information. This Policy applies to all personal and non-personal information received by Company whether in electronic, written, or verbal format.

Company reserves the right to modify this Policy at any time and will do so from time to time. Each modification shall be effective upon its posting to the Site. Your continued use of the Site following any such modification constitutes your acceptance of any changes to this Policy. It is therefore important that you review this Policy regularly. Any capitalized term used but not defined herein shall have the meaning prescribed in the Terms of Use. In the event of a conflict between this Policy and the Terms of Use, then the Terms of Use shall control.

1. Scope

This Policy covers the entire Site. However, it does not apply to entities that Company does not own or control including advertisers or developers of content. It also does not cover websites with posted links on the Site. These entities are governed by their own privacy policies and not this Policy. Please check the privacy policy of any entity you interact with on or off the Site.

2. Information Company Collects About You

Any time a guest or member (collectively "Users") accesses the Site they receive a "cookie" from Company. Company uses cookies (small pieces of data stored for an extended period of time on a computer, mobile phone, or other device) to make the Site easier to use and to protect both you and Company. These cookies give Company information about your use of the Site. You may remove or block cookies using the settings in your browser, but in some cases that may impact your ability to use the Site. Company may also use pixels, widgets and other tools to gather such information to improve the experience of the website or mobile application.

When you access the Site from a computer, mobile phone, or other device, Company may collect information from that device about your browser type, location, and IP address, as well as the pages you visit.

Company may collect data of the actions you take on the Site such as game scores each time you play a game, as well as the frequency and times in which you play games. These scores are used in the leaderboards for purposes of competition as well as for our research projects.

Some games will also record important game-related details, such as the time and location in the game world when you perform certain tasks. This information is used for the purposes of balancing game difficulty as well as enabling researchers to study player activity. These game data may be reported aggregately in research publications, but no personal information connecting your account details with these records is ever released to a third party without your explicit request.

Company may retain the details of connections or transactions you make on the Site.

3. Information You Provide to Company

As part of the process to become a member, Company requires you to provide your email address, user ID, password, and age. Other information may be requested but is voluntary and includes, but is not limited to, name, address, phone number, and sex.

Company may also collect information from links to other Company-developed products that you click on when using the Site.

Use of the Site may involve you posting Content through forums or blogs available on the Site.

4. How Company Uses Your Personal Information

Company uses the information you are required to provide to become a member in order to ensure you are at least thirteen (13) years of age. The Site is not meant to be used by anyone under the age of thirteen (13). Company may also use your age information to be sure you receive an age appropriate experience while using the Site. If you think someone has submitted information from someone under thirteen (13), contact Company and it will remove the information as soon as possible.

Company uses the information you are required to provide to become a member in order to evaluate if you are under the age of eighteen (18). If you are under the age of eighteen (18) but are at least thirteen (13) years of age, you may use the Site only under the supervision of a parent or legal guardian who agrees to be bound by the Terms of Use.

Company will use the information it collects to provide services and features to you. Company will also use the information to measure and improve the Site, and to provide you with customer support.

Company may contact you with service-related announcements from time to time. You may opt-out of all communications except essential updates. Company may include Content in the emails it sends to you.

Certain software applications and applets may transmit data to Company, but that transmitted information will not be stored by Company.

Company may use a variety of methods to detect and address anomalous activity and screen content to prevent abuse.

5. How Company Shares Your Information

Company shares your information with third parties when it believes the sharing is permitted by you, reasonably necessary to offer its services, or when legally required to do so. The following are examples of how Company shares your information, however, this list is informative not exhaustive.

  1. When you play a game, your game scores are recorded and used in the leaderboards for purposes of competition and Company's research projects.
  2. Some games will also record game-related details, such as the time and location in the game world when you perform certain tasks. This information is used for the purpose of balancing game difficulty as well as enabling researchers to study player activity.
  3. Company may disclose non-anonymous, analyzed data, such as game scores, frequency of play, and time of play, in the form of statistical data for research purposes at a research institution such as, but not limited to, the University of Wisconsin-Madison. These data will be available to researchers when:
    1. Researchers can provide documentation of IRB approval, specifying the duration of research,
    2. Researchers can provide documentation of a signed, IRB-approved consent form for each User for whom they wish to access identifiable data, and
    3. Each User logs in to his/her password protected account and confirms the release of his/her user ID to the third party either by signing for him/herself or, if under the age of eighteen (18), by obtaining the User's parent/guardian's signature. The parent or guardian will receive an email requiring the parent or guardian to confirm release of the User's user ID. The parent/guardian's electronic contact information will be specified by the research institution.
  4. Company may share information on a set of publicly-accessible interfaces. Anonymous, individualized data will be available to look at but will not be connected to a specific User.
  5. Company may also share information when it has a good faith belief it is necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from people violating the Terms of Use of the Site. This may include sharing information with other companies, lawyers, and courts or other government entities.
  6. Company may disclose information pursuant to subpoenas, court orders, or other requests (including criminal and civil matters) if it has a good faith belief that the response is required by law. This may include requests from jurisdictions outside of the United States if Company has a good faith belief that the response is required by law under the local laws in that jurisdiction, is applicable to Users from that jurisdiction, and is consistent with generally accepted international standards.

6. Business or Asset Transfer or Sale

Company may be sold, sell or buy businesses or assets of businesses, or merge with another business. In such transactions, personal information generally is one of the transferred business assets. Also, in the event that Company, a line of business of Company, or substantially all the assets of Company are transferred, personal information may well be one of the transferred assets. Company will make a reasonable effort to provide notice on the Site and to notify you via email to the most recent email address that you have provided to Company of any such change in ownership or control of your personal information.

7. Security

Company shall take reasonable steps to protect personal information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. Company has in place appropriate physical, electronic, and managerial procedures to safeguard and secure personal information. Company cannot guarantee the security of information on or transmitted via the Internet.

8. Data Integrity

Company shall only process personal information in a way that is compatible with and relevant to the purpose for which it was collected or has been authorized. To the extent necessary for those purposes, Company shall take reasonable steps to ensure that personal information is accurate, complete, current, and reliable for its intended use.

9. Access

Company will allow you access to your personal information and allow you to correct, amend, or delete inaccurate information. For access requests please contact us by email. Access will not be allowed where the burden or expense of providing access would be disproportionate to the risks to your privacy or where personal rights other than your own would be violated.

10. Other

Unless stated otherwise, Company's current Policy applies to all information that Company has about you and your account.
